Issue of acknowledgement of E.M.Part-ll in lieu of valid Permanent Registration Print E-mail

CIRCULAR

Sub: Issue of acknowledgement of E.M.Part-ll in lieu of valid Permanent Registration.

Consequent to the enactment of the Micro, Small & Medium Enterprises Development Act 2006, the concept of registration of units is substituted with the filing of application for issue of acknowledgement of Enterprises Memorandum.

  1. The said Act also provides to opt for Entrepreneurs Memorandum Part-ll by those units/enterprises which are already having permanent registration with this Directorate.
  2. A need has been felt to facilitate and simplify the procedure of issue of acknowledgement for E. M. Part-ll filed by units h?favj(ing valid Permanent Registration
  3. Now, therefore, in order to speedily dispose off such applications and to issue acknowledgement of E.M. Part-ll in a time bound manner, the following instructions are hereby issued:

(i) On receipt of an application for issue of acknowledgement of E.M. Part-ll in lieu of permanent registration, the Inward clerk after making necessary entry in the inward register shall immediately handover the said application to the Functional Manager/concerned Block Inspector/Extension Officer (Inds).

(ii) The concerned official shall scrutinize the said application to verify if the same is in order and duly supported with the requisite documents as per this office O.M. No. DI/Reg/MSMED Policy/2006-07/2504 dated 08-10-2008. In case of any deficiencies, the same should be brought to the notice of the concerned applicant either on phone or through letter asking the applicant to rectify the same immediately.

(iii)  However, if the application is submitted in person by the concerned applicant, the Functional Manager or the concerned Block Inspector/ Extension Officer (Inds) or in absence of them any other Industries Inspector/ Extension Officer (Inds) shall scrutinize the said application in terms of aforesaid Office Memorandum in presence of the said applicant(s) and shall request them to rectify the discrepancies found, if any. The Functional Manager/I.I's/E.O's shall render all the necessary support to the concerned applicant while scrutinizing. The concerned file of Permanent Registration of the unit should be linked to the application.

(iv) The applicant should not be requested to submit any unwanted documents/information. Further if the requisite documents are already available in the file of the Permanent Registration, the same documents should not be insisted again.

(v) It is submitted by various applicants that unnecessary inspection of the unit is conducted by this office to verify the functioning status of the unit. In this regards it is enjoined upon all the officials of this Directorate that in case if documents on record/returns filed etc. clearly speaks that the concerned unit is in operation/function, no fresh inspection be conducted. However, in case if the inspection is unavoidable then the said inspection should be conducted within 2 days of receipt of application.

(vi) Once the Functional Manager/concerned l.l./E.O. verifies that the entire application is in order, he/she shall process the application in a time bound manner and shall take personal responsibility to ensure that the acknowledgement of E.M. Part-ll to such unit is issued and dispatched within 10 days from the date of receipt of duly completed application.
